Terms of Service – cani-ninja.com

These Terms of Service (the "Terms") set out the rules for accessing and using the website www.cani-ninja.com (the "Site"). By browsing the Site, you accept these Terms. Any purchase is also subject to the Terms of Sale, which prevail in the event of any conflict.

Article 1 – Purpose and website publisher

The Site is published by CANI GOURMAND, SAS with a share capital of €500, registered with the Périgueux Trade and Companies Register under number 883 065 914, with its registered office at 3 Impasse de l'Artisanat, ZI La Borie, 24110 Saint-Astier (France). Intra-community VAT number: FR05 883065914. CANI NINJA is a brand of CANI GOURMAND.

Article 2 – Access to the Site

The Site is accessible free of charge to any user with Internet access. Connection and equipment costs are borne by the user.

CANI GOURMAND strives to keep the Site accessible at all times. However, access may be suspended for maintenance, updates or in the event of force majeure. These interruptions do not affect orders already confirmed.

Article 3 – Customer account

Creating an account is optional: you can order without one. If you create one, you agree to provide accurate information and to keep your login details confidential. Any use of your account is deemed to be made by you, unless you have reported fraudulent use to us.

You can delete your account at any time by writing to contact@cani-ninja.com.

In the event of a serious breach of these Terms (fraud, identity theft, unlawful content), CANI GOURMAND may suspend or close the account, after informing you of the reason by email, except in an emergency. Orders in progress will still be fulfilled under the conditions of the Terms of Sale.

Article 4 – Rules of use

You agree to use the Site fairly and lawfully. In particular, it is forbidden:

• to disrupt the operation of the Site or introduce a virus or any malicious code;
• to extract all or part of its content by automated means;
• to place fictitious orders or use a payment method without authorisation;
• to publish unlawful, abusive or defamatory content or content that infringes the rights of third parties.

Article 5 – Customer reviews and user content

Reviews published on the Site are collected using the Judge.me tool. In accordance with Articles L111-7-2 and D111-17 of the French Consumer Code, here is how they are handled:

• Verification: reviews are not subject to a verification procedure.
• Consideration: nothing is given in exchange for a review.
• Display: reviews are listed in chronological order, from newest to oldest. Each review shows its publication date. Both positive and negative reviews are published.
• Duration: reviews remain online for a maximum of 5 years.
• Refusal: a review may be refused or removed if it is unrelated to the product, abusive or discriminatory, contains personal data or is clearly false. Its author is informed and may contact us at contact@cani-ninja.com.

By publishing a review, you authorise CANI GOURMAND to reproduce it on the Site and on its social media, with your first name and the initial of your surname, for the publication period indicated above.

Reporting unlawful content: any content that you consider unlawful can be reported to contact@cani-ninja.com, stating where the content is located and why. CANI GOURMAND handles each report promptly and informs its author of the action taken (EU Digital Services Act, "DSA").

Article 6 – Intellectual property

The CANI NINJA brand and logo, as well as the texts, photos, videos and visuals on the Site, belong to CANI GOURMAND or its partners. Any reproduction or reuse, in whole or in part, without prior written authorisation is prohibited, except in the cases provided for by law (private use, short quotation).

Sharing a page of the Site on social media via a link is permitted.

Article 7 – External links

The Site may contain links to other websites, such as www.cani-ninja.fr for the CANI NINJA race, social networks or carriers. CANI GOURMAND does not control the content of third-party websites and is not responsible for it. Their use is subject to their own terms.

Article 8 – Liability

CANI GOURMAND takes care to ensure that the information published on the Site is accurate, in particular product descriptions, sizes and photos. If an error is found, it is corrected as soon as CANI GOURMAND becomes aware of it.

CANI GOURMAND is not liable for damage caused by use of the Site contrary to these Terms, by the act of a third party or by force majeure.

Nothing in these Terms limits your statutory rights. In particular, you always benefit from the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code), detailed in the Terms of Sale. CANI GOURMAND remains liable for its own faults and for the proper performance of your orders.

For your safety and your dog's, use the equipment in accordance with its instructions and the size guide.

Article 9 – Personal data and cookies

CANI GOURMAND processes your personal data in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act. The purposes, retention periods and your rights are detailed in the Privacy Policy.

You can exercise your rights of access, rectification, erasure, objection, restriction and portability by writing to contact@cani-ninja.com or to the postal address given in Article 1. You can also lodge a complaint with the CNIL (www.cnil.fr).

Non-essential cookies (audience measurement, advertising) are only set with your consent. You can change your choices at any time via the "Manage cookies" link at the bottom of the page.

Article 10 – Changes to the Terms

CANI GOURMAND may amend these Terms to reflect changes to the Site or to regulations. The version in force is the one published on the Site, with its update date. If you have an account, you will be informed by email of any significant change at least 15 days before it takes effect.

Changes do not apply to orders already placed.

Article 11 – Governing law, mediation and disputes

These Terms are governed by French law. If you live in another European Union country, you retain the protection of the mandatory rules of your country.

In the event of a problem, please first contact our customer service by email at contact@cani-ninja.com or by post to the address given in Article 1. We undertake to reply quickly.

Consumer mediation: if your written complaint has not been resolved, you may refer the matter free of charge to the consumer mediator to which CANI GOURMAND belongs: [Name of the mediator], [postal address], [website], in accordance with Articles L611-1 et seq. of the French Consumer Code. You must do so within one year of your written complaint.

Competent court: failing an amicable agreement, if you are a consumer, you may bring the matter before the court of the place where you lived at the time of the order or of the event causing the damage, or any other court with jurisdiction under the law. For business customers, the courts of Périgueux have jurisdiction.
